Terms of Service

1. Who can use the Platform

Accounts are for real estate practitioners registered with LPPEH (BOVAEA), the Board of Valuers, Appraisers, Estate Agents and Property Managers, as a Registered Estate Negotiator (REN), Registered Estate Agent (REA) or Probationary Estate Agent (PEA). Property owners, developers and other members of the public cannot open accounts. Buyers and tenants do not need an account: they use the Platform through ChatGPT.

You must be at least 18 years old and able to enter into a binding contract.

2. Your account

• You can sign up with an email address and password, or with Google. If you later sign in with Google using the same email address, it is linked to your existing account. One email address has one account.
• Your email address is verified when you sign up and cannot be changed afterwards. If you lose access to it, you need to open a new account.
• Before your first listing you must verify a Malaysian mobile number by one-time code. Your email, mobile number, WhatsApp work number and registration number can each belong to only one active account.
• You may change your verified mobile number or WhatsApp work number, but not again within 24 hours of a change, and no more than twice in any 30 days.
• Keep your sign-in details secret and do not share your account. You are responsible for everything done through it. Tell us at once at contact@shelterx.property if you suspect unauthorised use.

3. Registration verification

We verify every agent's registration before they can publish.

• By invitation: if you join through a personal invitation link from us, your account is matched to the registration number the invitation was issued for and verified automatically. Each invitation can be used once.
• By review: if you sign up yourself, you submit your registration type, registration number, registered name and firm details, and we check them against the LPPEH register. We aim to finish reviews within 24 hours. You can prepare draft listings while you wait, but you cannot publish until you are approved.
• A new account for a registration number that previously had a deleted account always goes through manual review.

We may ask for proof of registration at any time, and may reject a registration or suspend an account if it cannot be verified or is no longer valid. If someone has registered with your registration number, report it through our registration misuse form.

4. Listings

Once your registration is verified, your listings are published immediately, without a per-listing review. When you publish a listing you confirm that:

• you are entitled to market the property and, where the law requires it, you have the owner's written consent to advertise it;
• the listing is accurate, current and not misleading, and the photos show the actual property;
• the listing complies with the Valuers, Appraisers, Estate Agents and Property Managers Act 1981 (Act 242) and the rules made under it, including the requirement that advertisements show your firm's name and registration number and your own name and registration number, which the Platform shows with every listing; and
• you will update the listing when anything changes and close it as soon as the property is no longer available.

To keep one listing per property, these details are locked once a listing is published: sale or rent, property type, project or building name, state, city, area, unit address, built-up size and number of bedrooms. To change any of them you must create a new listing. Price, description, photos, furnishing and availability date can be changed at any time.

Descriptions are plain text of up to 2,000 characters. ChatGPT reads them and retells them to buyers in its own words.

When you close a listing you must give the reason and say whether the deal came from ShelterX. A listing marked as sold, rented or withdrawn cannot be relisted; create a new listing instead. We keep the edit history of every listing.

We automatically flag listings that look like duplicates or reused listings (for example, matching another listing's property details, or having most photos replaced after an edit) for review. If three different buyers report the same listing, it is paused and reviewed; its validity period keeps running while it is paused. We may remove or suspend any listing that breaks these Terms or the Acceptable Use Policy.

5. How listings are shown

Buyers see listings through our plugin in ChatGPT, a service run by OpenAI, and on the link-only listing and agent pages that you share. These pages are not listed on our website or in search engines. Other agents cannot see your listings in the Platform.

With each listing we show your registered name, your registration type and number, your firm's name and registration number, the languages you speak and the contact channels you have switched on (email, phone or WhatsApp; at least one must stay on). Messages started from a WhatsApp button include the listing number so you know which property the buyer means.

Results are ordered by objective criteria only: how well a listing matches the buyer's request, then how complete it is and how recently it was updated, with ties rotated at random. There is no paid placement.

Whether ChatGPT calls our plugin, and what it says about a listing, is decided by OpenAI and is outside our control. We do not guarantee any number of appearances, contacts or deals.

6. Houses

Houses are the credits used on the Platform. 1 House = RM1.

• Creating a listing costs 1 House and keeps it live for 60 days. You can extend a listing by 60 days for each House, choosing 1 to 6 Houses at a time, up to 360 days ahead.
• Houses never expire. They are not transferable between accounts, have no cash value and cannot be exchanged for money.
• Free Houses: new agents receive 10 free Houses once their mobile number and registration are verified. They are given once per registration number, ever: a new account with the same registration number, including after an account is deleted, does not receive them again, and no balance moves from an old account.
• Prices are shown in RM at the time of purchase. We may change prices for future purchases; this does not affect Houses already in your account.

Beta and production

Until our ChatGPT plugin is approved by OpenAI, the Platform runs in beta. During beta, listings still cost 1 House to create but do not expire, and extensions are unavailable. When we switch to production, every live listing gets a validity period of 60 days from the switch date. We will notify you on the switch day and remind you 7 days and 1 day before each listing expires. Buying Houses is possible in both phases.

7. Payments

Houses are bought on our website through Stripe Checkout, in Malaysian ringgit, by card or FPX online banking. Stripe processes your payment details; we never see or store your card number or banking credentials. Houses are added to your account once Stripe confirms the payment, and each payment is credited only once.

Before you pay, the Stripe Checkout page shows the package, price and payment method. Together with these Terms and our Refund Policy, it forms the information required under the Consumer Protection (Electronic Trade Transactions) Regulations 2012. These Terms are available in English, Bahasa Malaysia and Simplified Chinese.

House purchases are final, except as set out in the Refund Policy.

8. Deleting your account

You can delete your account in Settings by confirming your password (or signing in with Google again, if your account has no password) and a one-time code sent to your mobile number. Deletion is immediate and cannot be undone:

• all your listings are deleted and leave ChatGPT and their links at once;
• your mobile number and WhatsApp work number are released and can be used on a new account;
• any Houses left in the account and the remaining days on your listings are forfeited, without refund or transfer; and
• if you register again with the same registration number, the new account goes through manual review and does not receive free Houses.

9. Your content

You keep ownership of the listings, photos and other content you upload. You give us a non-exclusive, royalty-free licence to host, copy, format, translate and display that content, and to send it to ChatGPT and other services we use to operate the Platform, for as long as it is on the Platform and for a reasonable period afterwards for backups and caches. You confirm you have the rights needed to grant this licence.

AI tools. We offer optional tools that suggest improvements to your listing text and that fill in a listing from a link to your own listing on another website (currently PropertyGuru only). These tools use OpenAI's models. They only make suggestions: nothing replaces your content until you confirm it, and you remain responsible for checking it. You may only import listings that you published yourself. Imported photos may carry another platform's watermark; please replace them with your own originals.

10. Acceptable use

You must follow our Acceptable Use Policy, which forms part of these Terms.

11. Disclaimers

• Listings are provided by agents. We check agents' registrations, but we do not inspect properties or verify every detail of a listing, and we do not guarantee that a listing is accurate or available.
• ChatGPT generates its answers itself. Its summaries of a listing may be incomplete or wrong; the listing details returned by our plugin are what count.
• Nothing on the Platform is legal, financial, valuation or investment advice. Buyers and tenants should verify the property, the agent and all terms before paying any money or signing anything.
• The Platform is provided "as is" and "as available". We do not promise it will be uninterrupted or error-free.

12. Limitation of liability

To the extent the law allows, we are not liable for any indirect or consequential loss, loss of profit, business or opportunity, or for any loss caused by a transaction between users, or by fraud or misrepresentation by any agent, buyer, tenant or other third party. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits rights you have under the Consumer Protection Act 1999 that cannot be excluded.

13. Suspension and termination

We may suspend or close your account, and remove your listings, if you break these Terms or the Acceptable Use Policy, give false registration or account information, your registration is revoked, suspended or expires, we receive credible reports of fraud, or the law requires it. Where practical we will tell you first. We may also freeze an account while we investigate suspected fraud or report suspicious activity under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.

If your account is closed for a breach, Houses left in it are forfeited. If it was closed because of our error, we will restore your Houses or refund the unused paid Houses. We do not close accounts just for being inactive.

14. Governing law and disputes

These Terms are governed by the laws of Malaysia. We will first try to resolve any dispute with you in good faith. If that fails, the dispute will be referred to mediation and, if still unresolved, to arbitration in Kuala Lumpur under the rules of the Asian International Arbitration Centre (AIAC). Either party may still seek urgent relief from a court of competent jurisdiction.

If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, together with the Privacy Policy, Cookie Policy, Acceptable Use Policy and Refund Policy, are the whole agreement between you and METAKORE SDN. BHD. about the Platform. If a translation differs from the English version, the English version prevails.

15. Changes to these Terms

We may update these Terms. We will tell you about material changes by email or in your dashboard before they take effect. If you keep using the Platform after that, the updated Terms apply.
